Trademark Data - Source - Publication

On our platform tmdb.eu, we present structured information about registered trademarks. This includes information about the applicants or owners of trademarks, as officially provided by the German Patent and Trade Mark Office (DPMA) and the European Union Intellectual Property Office (EUIPO).

With a trademark, the owner receives an exclusive right of use and can prohibit third parties from using it. Therefore, third parties must also have the opportunity to inform themselves about trademarks and their owners.

This is why trademark data is publicly accessible. The recording of applicant/owner information is mandatory. There is generally no right to object to the publication of personal data (including § 62a Data Protection Trademark Act).

TMDB only receives this data in read-only mode within the framework of contractual data provisions and presents it in a structured form. No independent editorial processing or modification of the data takes place.

If you, as a natural person, do not wish your owner data to be publicly visible, we offer a technical option for anonymization on our platform – without prejudice and without acknowledgment of any legal obligation:

  • Click on the small incognito icon next to the owner entry.
  • Your data will then be:
    • hidden behind a login area,
    • marked with a "noindex" tag,
    • and requested for removal from search results via Google Webmaster Tools.

Please note: Removal from the Google index and cache can take several weeks. We have no influence on this.

Changes to name or address (e.g., due to relocation or change of ownership) must be requested directly from the responsible trademark office. Once the data there has been updated (usually within 2-3 weeks), it will be transferred to tmdb.eu with the next automated data import.

We have no influence on the data maintenance of the offices and do not make manual changes – however, we are happy to assist you in contacting the trademark office. The final implementation – from the application at the office to visibility at tmdb.eu – can take 3-4 weeks, in individual cases even longer.

Complete deletion of owner data on tmdb.eu only occurs when the associated trademark is deleted from the trademark register. There is no data protection claim for deletion, as the data processing is based on a legal basis. We cannot manually make any changes or deletions of owner data!

Trademark data is subject to publication requirements to ensure legal transparency. Related owner information may constitute personal data. However, publication is permitted without the consent of the trademark owner. Anyone who registers a trademark must therefore expect their owner data to be publicly named. A "right to erasure" under GDPR does not exist for valid trademark entries, as these must remain public for transparency reasons. Only when a trademark is deleted or expired are the associated entries archived or removed by the trademark office according to legal requirements.

Data provision using the DPMA as an example

The data published by the German Patent and Trade Mark Office (DPMA) in connection with intellectual property proceedings is also transmitted to third parties such as tmdb.eu on a contractual basis. In doing so, the DPMA takes into account data protection requirements for handling personal data whose publication is required by law.

This data enables the establishment and operation of proprietary intellectual property databases such as tmdb.eu. In this way, the DPMA supports and facilitates the dissemination and use of official intellectual property information in digital applications.
