German brand or union brand (EU brand)?

  • Brand protection in Germany

    Brand protection in Germany: Brand protection always applies in the country where the trademark is registered. In other countries, identical or similar characters can be used by third parties.

    Trademark protection can be applied for every 10 years by paying the renewal fee of currenttly EUR 850 (1st class) for a further 10 years. With the exception of the amount of the renewal fee, there is no difference to the German mark.

    The risk of trademark conflicts in a European Union brand is significantly higher because both union brands and national brands of all 28 member states can take action against a conflicting European Union trademark application. What are the costs of signing a trademark?

When registering a trademark, legal fees for the examination and application (lawyers fees) and official fees of the trademark office are usually incurred.

What is the DPMA registration fee?

The official registration fee of the German Patents and Trademark Office for a German trademark is EUR 290. This fee applies to up to 3 classes of goods or services. A class lists the goods or services for which the trademark is to be protected (e.g. in class 25 "clothing, footwear, headgear.") For most trademark applications, 3 classes are sufficient.

For each additional class starting at the 4th class the DPMA €100 charges additional fees per class.

What is the official fee of a European Union trademark (EUIPO)?

EUIPO's official registration fee for a European Union trademark (EU trademark) is €850 for 1st class, EUR 50 for the 2nd class and 150 euros per class for each additional class.

When are the office fees due?

The official fee of the DPMA or EUIPO is charged when a trademark is registered. The official examination procedure does not begin before the payment has been received.

Will the registration fees be reimbursed upon withdrawal of the application?

No. The filing fee will not be reimbursed once filed and payed. Even if the trademark application is voluntarily withdrawn, the application fees will not be reimbursed.

What happens if a trademark application has been refused?

In the event of rejection of a trademark due to lack of protection or deletion due to a contradiction, the office registration fees will not be reimbursed by the trademark office. Therefore, a trademark search should be carried out before a trademark is filed in order to reduce the risk that the filing fees have been paid for free.

How much does it cost to renew a brand?

The extension of a German trademark or european union brand can be applied every 10 years for further 10 years.

Fees for the renewal of a German trademark:

The renewal fee of the DPMA costs 750 euros (up to 3 classes). For each additional class starting at 4th Class must be paid an extension fee of 260 euros.

Fees for the renewal of a European Union trademark (EU):

EUIPO's renewal fee costs €850 for one class, €50 for second class and €150 for each additional class.

How long does the trademark application in Germany take?

Within 3-5 working days of receiving your order, we will send you a detailed audit report by e-mail. After consultation with you, we file the trademark electronically with the DPMA. The DPMA needs approx. 4-6 months until registration of your trademark. As part of an express order, you will receive our report from us within 48h (Mon-Fri). After paying an acceleration fee of EUR 200, the Office registers the trademark in approx. 4-6 weeks (instead of 4-6 months).

How long does it take to register for a European Union trademark?

Within 3-5 working days of receiving your order, we will send you a detailed audit report by e-mail. After consultation with you, we file the trademark electronically with EUIPO. EUIPO needs approx. 6-8 weeks to examine and publish your brand. After the expiry of an opposition period of a further 3 months, your European Union trademark will be registered. Why should a trademark search be carried out before registering the trademark?

Signing up for a new trademark can always result in the violation of an older brand. As a result, high costs by trademark infringement may arise. In addition, a new trademark name has to be chosen. This can be avoided at low cost by a trademark search before registering a trademark. If risky marks are found, we will help you regarding your strategy to register a strong trademark anyway. Especially in the case of the European trademark application, the search should be carried out. Because already one ealier trademark in one country of the EU can bring down your European Union trademark.

How long is my trademark protected by registration?

Your trademark is in Germany or in the European Union protected for 10 years. After the expiry of this period of protection, trademark protection may be renewed every ten years. We remind you in time to renew you trademark.

I have no residence or branch in Germany or the EU. May I still register a trademark?

Yes, of course. However, if you do not have a place of business or domicile within the European Union, you must choose a representative for all proceedings before the European Union Intellectual Property Office (EUIPO). When we register your trademark in Germany, our lawyers automatically become your representatives before the German Patent and Trademark Office.

Can you defend my brand if someone infringes my brand?

Sure. Our trademark attorneys may approach the trademark infringer, send a warning letter, sue or file an opposition before the trademark office for you. Just contact us. We are happy to help you, since a strong brand has to be defended.

When can I use the ® or TM sign?

You may not use the ® in a circle (for "registered") until your trademark has been registered. However, there is no obligation to use the sign next to your trademark. However, the use of the R symbol can inform third parties that a trademark is registered and thus prevent injuries. But be careful: If you use the ® in a circle before registering your trademark, you risk a warning for a breach of competition in Germany. The sign "TM" (for "Trademark"), on the other hand, has its legal background in the Anglo-American legal area.
