If you want to enter the European Union with an European Union brand, a comprehensive preliminary search for existing identical or similar brands within the European Union and the individual Member States is essential.
Already one existing trademark application in a Member State of the European Union, however small, can bring down its European Union trademark in its entirety. This is particularly annoying, if you have no business interests at all in the country where such a clashing brand exists. However, these trademark owners perceive through the trademark application that you have potential business interests in their country.
In this respect, we carry out the search not only in the register of the European Trademark Office (EUIPO), but also in all 28 national trademark registers of the European Union.
If, as is often the case, it turns out that the brand is problematic in one of the countries, one can still consider registering the brand for the other countries. This can of course only be found out after previous research. But if this is relevant to you, this is a very good strategy to avoid loosing your brand as a whole.

If you wish to carry out an international trademark application, you should have a search carried out in the respective countries before registering the base mark, which will give you an overview of the countries in which the invented brand name is still And where older brands may be in the way of the project.
If you already know that you want to protect a brand not only in Germany, but also in the USA, China or India, you should not limit yourself to a brand search in Germany. In these cases, we recommend that a search be carried out first in all relevant countries to see if you project can be implemented. If it turns out that there may be conflicting brands in individual countries, you can then decide whether you will nevertheless register the trademark in the core countries that are important to you and leave the other countries out, or whether you may switch to another brand name.

Note: In countries such as the United States or China, for example, a trademark will not be registered by the Trademark Office if there are already colliding trademarks. In China, short deadlines make a solution almost impossible. With a brand search in advance, you avoid such situations.

Part of our brand database are the trademark registers from Germany (DPMA), the European trademark register for Union brands (EUIPO) as well as the trademark registers of Switzerland (Swissreg) and the USA (USPTO).
The brand database is constantly being expanded and the research optimized with new features. However, the free search is limited to a simple identity search, which corresponds to a so-called K.O. search.

Then we make sure that, on the one hand, proper research has been carried out and, on the other hand, the search results are properly evaluated.
