Why is a brand similarity research advisable?

A trademark infringement is not only the case by unlawfully use of the trademark in an identical way. A trademark infringement may also be the case by the use or registration of a similar trademark. As a result, the violation of a trademark by similar trademarks is even more common than the violation of a trademark by identical trademarks. A brand is similar to another brand, if it is written differently but pronounced identically. If it matches in tonal, conceptual or meaning it might be similar as well. A professionally conducted brand search should therefore always include a search for similar brand names.

A brand search is too expensive for me. Do I really need to do some research?

Yes, you absolutely should. Either you research yourself or let us investigate whether there are possible risks in connection with your trademark application or use of your trademark. Even if you are just getting started and may only have a small budget, you should not save money in the wrong place. A professionally conducted trademark search can save you a lot of money and trouble. After all, a once issued warning letter by the other side costs already €1500-2000. Even if you only sold one single T-shirt and made only five euros in profit in the process. It is precisely in such scenarios that can quickly challenge the business model itself. The investments of a professionally conducted brand research therefore pay off very quickly. As a result, you need to break down the cost over a period of ten years in which your brand will initially be valid. Which trademark registers do you research?

We always do research in the relevant brand registers. For Germany, this is, for example, the trademark register of the German Patent and Trademark Office (DPMA), the Register of Union Trademarks at the European Union Intellectual Property Office (EUIPO) and the WIPO Register of International Trademarks with respect to Germany. When we conduct an EU 28 research, we also research all 28 national brand registers of the European member states.

What does brand research do?

Through professional brand research, we can identify possible risks associated with the use and registration of your brand. At the end of an examination, you will receive a clear statement as to whether or not there are older identical or similar brands are a potential risk or not. If there is a potential for conflict, we will discuss together how we can reduce this risk. This can be by adding more items to the brand name or restricting the class directory. In exceptional cases, we may advise you to choose a completely new brand name. In this case, we will also be happy to help you research other names.

What happens if my brand is no longer available?

If your brand is found to be no longer available because there are older identical or similar brands that are antithetical to your brand, we’ll discuss with you how we can minimize any risks. In some cases, it may be necessary for you to switch to a whole new brand name.

How much does it cost if I want to have several brand names researched?

In this case, it is best to send us a list of the names you want to have researched. Let us also know in which area the brand names are to be used. Please also prioritize the brand names. We can then make an offer for a complete search. The model has proven its worth that we carry out the first brand on our usual research prices and charge for further research according to effort. Then, when we arrive at a brand where there are no risks, we stop the research and communicate the result. Even understandably, we can also make a different agreement on an individual basis. Are you libar in the event of misrepresentation?

Yes. The trademark research is carried out by a law firm. As part of the mandate relationship with you, the latter is normally liable for a false consultation. So far, however, this case has not yet occurred. Our lawyers, even in self-interest, are doing everything in their power to ensure that such a liability case will not occur in the future and that they will have a strong brand.

Do you also do a picture stamp search?

Yes, we can also do a search for pure picture marks. However, this is more complex for technical reasons and usually less reliable than a search for word marks or. Word components in word picture marks. We regularly carry out pure image stamp searches according to effort, because depending on the starting mark, the research can be very different and time-consuming. Just talk to us about this.

Is the standard research package also included research for image components?

Yes and no. We regularly only research for word components. In the case of word marks, this is clear. In the case of word image stamps, it is regularly only the word component of a brand that matters. Trademark law, in the event of a conflict, the image component regularly withdraws, making it less important under trademark law. Exceptions may only be purely descriptive word components embedded in a logo. Here it can be important how a logo is designed. In the case of simple and effort manageable image components, we also cover these searches in our research packages.
